1. Acceptance of Terms

By downloading, installing, or using PicWrite ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

2. Description of Service

PicWrite is an AI-powered mobile application that generates captions for photos. The App processes your images using artificial intelligence to create multiple caption suggestions that you can customize and share on social media platforms.

2.1 Free Version

The free version allows one generation per day with watermarked exports.

2.2 Premium Subscription

The premium subscription ($4.99/month) provides unlimited generations and clean exports without watermarks.

3. User Content and Privacy

When you upload photos to PicWrite:

• Photos are processed by our AI service to generate captions
• Photos are automatically deleted immediately after processing
• We do not store, share, or use your photos for any other purpose
• Your generation count and preferences are stored locally on your device only

4. Subscription Terms

Premium subscriptions are subject to the following terms:

• Subscriptions auto-renew monthly unless canceled at least 24 hours before the current period ends
• Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your Apple ID Account Settings
• No cancellation of the current subscription is allowed during the active subscription period

5. Acceptable Use

You agree to use PicWrite only for lawful purposes and in accordance with these Terms. You agree not to:

• Upload illegal, harmful, threatening, abusive, or inappropriate content
• Violate any laws or regulations
• Infringe upon the rights of others
• Attempt to reverse engineer, modify, or tamper with the App
• Use the App to generate content that violates third-party rights

6. Intellectual Property

PicWrite and its original content, features, and functionality are owned by PicWrite and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind. We do not guarantee that:

• The App will be error-free or uninterrupted
• Generated captions will meet your specific needs
• The App will be compatible with all devices or operating systems

8. Limitation of Liability

To the maximum extent permitted by law, PicWrite shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other damages arising from your use of the App.

9. App Store Terms

Your use of PicWrite is also subject to Apple's App Store Terms of Service. In case of conflict between these terms and Apple's terms, Apple's terms shall prevail regarding your use of the App through the App Store.

10. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

11. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify users through the App or other reasonable means. Continued use of the App after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
